Unlike other sex crimes defined by law in Idaho, there must be sexual penetration as well as one of the following conditions in order to sustain a charge of rape:
- The female victim is under the age of 16 and the accused is 18 or older
- The female is 16 or 17 and the perpetrator is at least three years older
- If the female is incapable of consent due to temporary or permanent mental illness, mental or physical disability
- Where the female attempts to resist but is overcome by an assault or other violence
- Where harm is threatened or submission comes as a result of a drug being administered, or intoxication is an issue
- If the victim was asleep at the time the offense occurred
- If the victim believed the perpetrator was her husband and consented, and is convinced of this falsehood intentionally
- Where a female consents because she believes she will be harmed or a secret exposed that will expose her to contempt or ridicule
